State (DB) – presumption under Section 20 of P.C. Act – If it is proved that, an accused had accepted or agreed to accept illegal gratification/tainted money, the presumption under Section 20 of P.C. Act 1988 can be raised even without direct evidence for demand. The view expressed in the case of P. Sathyanarayana Murthy Vs. District Inspector of Police, State of Andhra Pradesh & other (2015) 10 SCC 152 – (3 judges Bench) has been doubted in the case of Neeraj Dutta Vs. State (NCT of Delhi) (2019) 14 SCC 311 and proposal was made to refer the matter to a larger bench.
